The Council is going to have quite a time trying to introduce a PSPO. The guidance on PSPOs states Council need to determine that the activity to be banned: • has a detrimental effect on the quality of life of those in the locality (or it is likely that activities will take place and have such an effect) • is (or is likely to be) persistent or continuing in nature • is (or is likely to be) unreasonable • justifies the restrictions being imposed. This is all rather vague and a gold mine for lawyers as they argue about what it means. In practice, PSPOs have been introduced to date to keep dogs on leads, stop young people assembling in parks (where there is evidence of public drunkenness) and in Kensington to prevent wealthy young Arabs revving their expensive cars exuberantly. The Council also has to give due regard to Articles 10 and 11 of the Human Rights Act which covers freedom of expression, and freedom of assembly and association. I wonder how much Council taxpayers' money will be thrown at this. |
