Paul, I'm not sure if 'hmm' is an expression of ethical disapproval or a belief that my reasoning on the law is unsound. If you believe it is wrong to run a car engine for a few minutes to make things more comfortable for a vulnerable elderly person because of environmental harm, I don't think it is likely that you would be able to alter your convictions. On the other hand if your quibble is on the legal point, there is good evidence to suggest I am right. The only local authority in the country who seems to pursue vehicle idlers is Westminster. From 2018 to 2023 there were over 70,000 complaints made but only 63 PCNs were issued. If memory serves me right, some of these fines were given to cars that council officers believed were operating as unlicensed taxi cabs outside night clubs in the West End. In Scotland there were over 1,000 complaints and only one PCN issued. The problem for the authorities with the inclusion of the word 'unnecessarily' in the wording of the legislation is that, should a PCN be challenged there would be a need to prove this for the fine to stand. Given the very low fine rate, it seems likely that this law has probably never been tested in court and those that do pay up are only the most egregious offenders. The bottom line here is if you genuinely believe outside conditions could compromise your health or the health of a passenger, keep your engine and the A/C running. You are not breaking the law or at risk of a fine.
