Under Regulation 98 of the Road Vehicles (Construction and Use) Regulations 1986, it's an offence to leave a vehicle engine running unnecessarily while stationary. The relevant word in this context would be "unnecessarily" which will exempt me in the circumstances I described and drivers leaving engines on in hot weather. The law is rarely enforced although local authorities do have the power to impose PCNs and Ealing civil enforcement officers can fine you £80. Since they took on the power in 2023 no fines have been issued. This is probably why motorists ignore the signs by the Churchfield Road crossing. Perhaps this is arguably less anti-social now with the closure of the nursery they were outside. This non-enforcement suggest the burden of proof for court would be for them to prove the idling was unnecessary.
