Tricia: that is unclear. The council initially rebuffed all appeals (before payment) blithely stating it was the fault of the PCN recipient's memory. Since the PCNs were issued as a result of their IT system's breakdown their response was, and is still, infantile at best and disingenuous at worst.
The council now states that payment of these illegitimate and unjust PCNs is an admission of liability and they will block appeals with this 'legislation'.
An experienced legal mind will know the way to find redress and refunds for those who are out of pocket.
